These Terms of Service govern your use of tryeverhold.com and purchases made from Everhold. By visiting the site or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, do not use the site.

1. Store platform

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

2. Eligibility and account information

You must be at least the age of majority where you live, or have permission from a parent or legal guardian, to place an order. You agree to provide current, complete, and accurate contact, billing, and shipping information and to keep any account credentials secure.

3. Products and information

We make reasonable efforts to describe and display products accurately. Screen settings, production batches, and photography can cause minor differences in color or appearance. Individual comfort and experience vary. Everhold products are everyday dining aids and are not medical devices, treatments, or substitutes for professional medical advice. Any material, care, measurement, or performance statement applies only when expressly stated on the product page or packaging.

4. Prices, payment, and taxes

Prices are shown in the currency displayed at checkout and may change before an order is placed. You authorize us and our payment providers to charge the total shown at checkout. Applicable taxes and available discounts are calculated at checkout. We may correct an obvious pricing or description error before fulfillment and will offer the choice to confirm the corrected order or receive a full refund.

5. Orders and availability

An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may limit or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, or an obvious pricing error. If we cancel after payment, we will refund the affected amount to the original payment method.

6. Shipping, returns, and refunds

Shipping estimates and procedures are described in our Shipping Policy. Returns, refunds, replacements, and cancellations are described in our Refund Policy. Those policies form part of these Terms.

7. Acceptable use

You may not use the site or its content for unlawful, fraudulent, abusive, or harmful purposes; interfere with security or operation; introduce malicious code; scrape or copy protected content at scale; impersonate another person; or violate another person's rights.

8. Intellectual property

The Everhold name, site design, original text, graphics, photographs, and other content are owned by or licensed to Everhold and are protected by applicable intellectual-property law. You may use the site for personal shopping purposes, but no other license is granted without written permission.

9. Third-party services and links

The site can include services or links provided by Shopify, payment providers, carriers, analytics providers, social platforms, and other third parties. Their services are governed by their own terms and privacy notices. We are not responsible for third-party sites that we do not control.

10. Disclaimer and limitation of liability

To the fullest extent permitted by law, the site is provided on an "as available" basis without promises that access will always be uninterrupted or error-free. Everhold is not liable for indirect, incidental, special, or consequential loss arising from use of the site or products where such limitation is permitted. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.

11. Indemnification

To the extent permitted by law, you agree to be responsible for losses caused by your unlawful use of the site or a material breach of these Terms. This section does not apply to ordinary consumer use or reduce any mandatory consumer protection.

12. Changes and severability

We may update these Terms for operational, legal, or regulatory reasons by posting the revised version and its effective date. Changes apply prospectively. If a provision is unenforceable, the remaining provisions continue in effect.

13. Governing law

These Terms are governed by the laws of Sweden, without depriving a consumer of mandatory protections available in the place where the consumer lives. Before starting a formal dispute, please contact us so we can try to resolve the issue.
